On May 11, 2026 the Estacada City Council adopted two resolutions which suspend both business licensing and land use actions for any new marijuana, hemp, cannabis, or industrial hemp processing, production, or wholesaling businesses within the city. They also adopted two resolutions which may impact businesses in the future. You may have questions related to the impact on your business and this FAQ hopes to answer some of these questions.
Cannabis business in the answers below refers to all marijuana, hemp, cannabis, and/or industrial hemp processing, production, or wholesaling businesses unless otherwise specifically called out. This is a general overview and does not encompass all the details in the resolutions and ordinances. We do recommend that you read the documents as included in the May 11, 2026 City Council packet for a complete picture of the changes.
Not right away but potentially in the future. Ord. 2026-008 would prohibit new marijuana businesses, but it is being referred to the voters in the next general election. It will go into effect if the electors of the City of Estacada vote to adopt the prohibition starting the date of the certification of the election sometime in November of 2026.
Ord. 2026-009 does allow for a licensing option for pre-existing marijuana businesses, but this only goes into effect if Ord. 2026-008 does. This could impact currently operating businesses because there would be no change in the terms of the license or registration including change of production type, increase tier size, added endorsements, change of ownership, change of location, and/or change, alteration, or modification of the premise.
The business licensing suspension lasts for one year, or until council takes additional action.
The land use suspension lasts until September 8, 2026, unless extended by council for an additional six months at that time.
The City does not allow for business license transfers; this means that a new business owner of an existing business will need to apply for and receive their own independent business license from the City, which would be a new license. If the application was not received prior to May 11, any new business owner in this position would be affected and would not be able to apply for a business license during the suspension.
