12.16.300 Violations--Penalties.

Any person violating any of the provisions of this chapter is guilty of a misdemeanor and, upon conviction, shall be fined not more than five hundred dollars ($500.00). Each day a violation exists is a separate offense and shall be punished as such. As an alternative remedy a violation of this chapter shall constitute a nuisance and the city may use other remedies that are legally available for enforcing this chapter including, but not limited to, injunction, mandamus, abatement, and other appropriate proceedings to prevent enjoin temporarily or permanently abate or remove the excavation.
