Chapter 12.12 PRIVATE DRIVEWAYS
12.12.040 Variance from private drive requirements.
The city council, upon appeal, is authorized to grant a variance from the
requirements applicable to construction of private drives intersecting public
streets when the applicant can show that by reason of particular and exceptional
conditions the strict application of this chapter would result in real and
unnecessary hardship, and the council through its investigation and the evidence
before it is satisfied that the granting of the variance will alleviate a
hardship and will not be detrimental to the public welfare and adjacent
property. In granting such variance, the city council may impose such
requirements upon the applicant as may be necessary under the circumstances to
carry out the intent and purpose of this chapter. (Prior code §
