Chapter 10.08 ADMINISTRATION AND ENFORCEMENT
10.08.050 Immobilization.
A. When an order of immobilization is issued as stated in
this chapter, the city shall cause the vehicle to be immobilized until eleven
a.m. of the following business day, by installing or attaching to the vehicle a
device designed to restrict the normal movement of the vehicle. A notice shall
also be placed on the vehicle stating:
1. That the vehicle has been immobilized by order of the
Estacada municipal court for failure to post bail, pay fines, or both;
2. A description of the vehicle and its location;
3. How to obtain release of the vehicle;
4. The date and time when the city will have the vehicle
towed and stored at the owner’s expense, resulting in the sale of the
vehicle to satisfy the expense of immobilization, towing, and unpaid bail or
fines if the owner fails to redeem the vehicle;
5. That attempting to remove the device, removing the device,
or moving the vehicle while immobilized, is an offense punishable under this
title.
B. Unless release of the vehicle is arranged by eleven a.m.
of the following business day, the city shall remove the vehicle from its
location as provided in Section 10.08.070.
C. The parking restrictions of this code shall not apply to a
vehicle that has been immobilized under the provisions of this code.
D. There shall be a charge of fifty dollars ($50.00) assessed
for the immobilization of a vehicle, which shall be in addition to any
outstanding bail or fines. (Prior code § 6.263)
