10.08.040 Failure to pay--Notice of hearing--Order to immobilize or impound.

A. Upon the failure of the owner or operator of a motor vehicle to pay unpaid bail, fines or assessments, or a combination thereof, for two or more parking violations, notice of delinquency shall be given to the registered owner of the vehicle as shown by the records of the Motor Vehicles Division of the state where the vehicle is registered. Notice shall be sent by certified mail. The registered owner shall be given thirty (30) days from the date of the notice to either post the bail, pay the fine, or request a hearing before the municipal judge to contest the parking citations received.
B. Upon failure of the registered owner to post bail, pay the fines or request a hearing within thirty (30) days, the municipal judge shall issue an order directing the immobilization of the vehicle should the vehicle be found on a city street, city property, or property controlled by the city.
