Chapter 9.12 OFFENSES AGAINST PUBLIC PEACE AND DECENCY
9.12.070 Prohibited noises.
The following acts are declared unreasonable noises in violation of this
chapter:
A. To produce or permit to be produced with a sound-producing
device when measured at or within the boundary of the property on which a
noise-sensitive unit that is not the source of the sound is located, or, within
a noise-sensitive unit which is not the source of the sound, exceeds fifty (50)
dBA between the hours of ten p.m. and seven a.m. or sixty (60) dBA between the
hours of seven a.m. and ten p.m.
B. Any sound plainly audible between the
hours of ten p.m. and seven a.m. within a noise-sensitive unit that is not the
source of the sound.
C. The use of exhaust brakes (jake brakes) except in an
emergency is prohibited at all times within the city, regardless of noise
level.
D. No person shall allow the discharge of exhaust from any steam
engine, stationary internal combustion engine, motorboat, motorcycle or motor
vehicle except through a muffler or other device that will effectively prevent
loud or explosive noises.
E. Any excavation or the construction, erection,
repair, alteration or demolition of a building or structure other than between
the hours of seven a.m. and eight p.m. Monday through Friday, or between the
hours of eight a.m. to five p.m. on Saturdays and Sundays. Exceptions may be
granted per the variance procedure in Section 9.12.090 for a period not to
exceed ten (10) days. Such permit may be renewed for periods of five days while
