ESTACADA PLANNING COMMISSION MINUTES

THURSDAY, APRIL 24, 2008 – 7:00 PM

1.       CALL TO ORDER

 

The meeting was called to order at 7:00 pm.

 

2.       ROLL CALL

 

Present:  Cm. Cameron, Cm. James, Cm. Sager, Cm. Ennis, Cm. Piper, CP Hoelscher, DCR Hovda.

 

Absent:  Cm. Anderson & Cm. Hnidey. 

 

 

3.       APPROVAL OF MARCH 27, 2008 MINUTES

 

Consensus was to approve the minutes as presented (Cm. Sager abstained).

 

4.       PUBLIC HEARINGS

 

A.     CONTINUATION:  Land Partition Application #2008-1.  The Applicant, Matt Pitzl, is requesting a three-lot partition of property described as 34E, 21CB, tax lot 120, which is located on the southeast corner of the intersection of 6th Avenue & Cemetery Road. The subject property is zoned R-1. This application is subject to the criteria in Section 16.16, 16.104, 16.108, 16.116, 16.120 and 16.132 of the Estacada City Code. 

 

Chrm. Cameron opened the public hearing.

 

CP Hoelscher clarified some of the issues that were of concern at the last meeting.  A road maintenance agreement was proposed by CP to address the vegetation that is in the right-of-way area. 

 

Matt Pitzl, applicant, said they can fit the house plans on the lot going with 20’ setbacks from the easement area instead of the property line.  It doesn’t make any difference to them. 

 

CP reviewed the staff report and the recommended conditions.  Consensus was to have staff review the plans for the footbridge prior to construction; include a landscaping plan submitted to the city along the north property line (parcel 1 & 2); and a road maintenance agreement

 

Cm. Piper moved to approve Variance Application #2008-1 with the conditions in the staff report and the 3 that were added tonight.  Cm. James seconded the motion.  Roll Call Vote:  Cm. James – yes, Cm. Sager – no, Cm. Ennis – yes, Cm. Hnidey – yes, Cm. Piper – yes, Chrm. Cameron – yes.  Motion passed 4-1.

 

B.      Land Partition Application #2008-2.  The Applicant, Lisa Barker, DBA LMB Permit Service, is requesting a two-lot partition of property described as 34E, 21CB, tax lot 114, which is located at 580/590 Caden Court.  The subject property is zoned R-1. This application is subject to the criteria in Section 16.16, 16.104, 16.108, 16.116, 16.120 and 16.132 of the Estacada City Code. 

 

Chrm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

Chrm. Cameron read a statement regarding evidence.

 

CP reviewed the staff reports, which both recommend approval. 

 

Cm. Piper moved to approve Variance Application #2008-2 with the conditions in the staff report.  Cm. Sager seconded the motion.  Roll Call Vote:  Cm. James – yes, Cm. Sager – yes, Cm. Ennis – yes, Cm. Piper – yes, Chrm. Cameron – yes.  Motion passed 5-0.

 

C.     Land Partition Application #2008-3.  The Applicant, Lisa Barker, DBA LMB Permit Service, is requesting a two-lot partition of property described as 34E, 21CB, tax lot 115, which is located at 560/570 Caden Court.  The subject property is zoned R-1. This application is subject to the criteria in Section 16.16, 16.104, 16.108, 16.116, 16.120 and 16.132 of the Estacada City Code. 

 

Because there were to applications by the same applicant, one public hearing was held for both applications. 

 

Cm. Piper moved to approve Variance Application #2008-3 with the conditions in the staff report.  Cm. Sager seconded the motion.  Roll Call Vote:  Cm. James – yes, Cm. Sager – yes, Cm. Ennis – yes, Cm. Hnidey – yes, Cm. Piper – yes, Chrm. Cameron – yes.  Motion passed 6-0.
