ESTACADA PLANNING COMMISSION MINUTES
THURSDAY, MARCH 27, 2008 7:00 PM

1. CALL TO ORDER
The meeting was called to order at 7:00 pm.
2. ROLL CALL
Present: Cm. Cameron, Cm. James, Cm. Anderson, Cm. Ennis, Cm. Hnidey, Cm. Piper, CP Hoelscher, DCR Hovda.
Absent: Cm. Sager.
3. APPROVAL OF FEBRUARY 28, 2008 MINUTES
Consensus was to approve the minutes as presented.
4. PUBLIC HEARINGS
A. Variance Application #2008-1. The applicant, Lisa Barker, is requesting a variance from Section 16.28.040(C) of the Estacada zoning code, to allow a 18 2 front setback instead of the required 20 for a single family dwelling. The property is zoned R-2 (Low Density Residential) and is subject to sections 16.16 & 16.100 of the Estacada Municipal Code. The property is described as 34E, 21CB, tax lot 112 597 Caden Court.
Chrm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.
CP reviewed the staff report which recommends denial.
Chrm. Cameron read a statement regarding evidence.
Lisa Barker, applicant, stated that all three properties have some sort of drop off, this lot just ahs a great de3al more. There have been numerous slides in the media and they want to build the safest house they can and have it be similar to the neighboring houses.
Cm. Piper asked if they plan to request variances for the other tax lot. Ms. Barker stated they are not planning to.
Chrm. Cameron asked if it is possible to build a house with a different footprint to allow it to fit without a variance. Ms. Barker stated it is possible.
Cm. Piper stated that he cannot find any where in the geo-tech report that was submitted where it states this house cant be built.
Chrm. Cameron closed the public hearing.
Cm. Piper moved to deny Variance Application #2008-1 because they knew when they bought the property what they had to work with and because the geo-tech does not state this house cannot be built. Cm. James seconded the motion. Roll Call Vote: Cm. James yes, Cm. Anderson yes, Cm. Ennis yes, Cm. Hnidey no, Cm. Piper yes, Chrm. Cameron yes. Motion passed 5-1.
B.
Land Partition
Application #2008-1. The Applicant, Matt
Pitzl, is requesting a three-lot partition of property described as 34E, 21CB,
tax lot 120, which is located on the southeast corner of the intersection of
6th Avenue Cemetery Road. The subject property is zoned R-1. This application
is subject to the criteria in Section 16.16, 16.104, 16.108, 16.116, 16.120 and
16.132 of the Estacada City Code.
Chrm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.
CP reviewed the staff report which recommends approval with conditions.
The Commission discussed the application and why they are going to be pumping the sewer up hill instead of going down hill and tying into the schools main.
Lisa Barker, on behalf of applicant who is sick (they both work for the same company), stated she is not sure whey they are pumping the sewer.
The Commission discussed the builability of the lots and the setback requirements from Wade Creek and from the easement area.
Chrm. Cameron is concerned about traffic going up Coupland Road and see oncoming traffic on the wrong side of the road because they are coming out of the proposed private driveway. He recommended requiring some sort of vegetation to hinder this view.
Lisa Barker stated she does not have any problem with the list of conditions, including the street lights.
The Commission
asked Ms. Barker if they could reset this application to get clarification on
several key elements. Ms. Barker agreed
this would be a good idea. CP Hoelscher
will email Ms. Barker a list of concerns from the meeting and consensus was to
reset the application to the April 24, 2008 Planning Commission meeting.
