ESTACADA PLANNING COMMISSION MINUTES

THURSDAY, NOVEMBER 15, 2007 – 7:00 PM

CITY HALL

 

1.         CALL TO ORDER


            The meeting was called to order at 7:00pm.

 

2.         ROLL CALL

 

Present:  Cm. Cameron, Cm. James, Cm. Anderson, Cm. Hnidey, CP Hoelscher, DCR Hovda. 

 

Absent:  Cm. Ennis, Cm. Sager, Cm. Piper.

 

3.         APPROVAL OF SEPTEMBER 27, 2006 MINUTES

 

            Consensus was to approve the minutes as presented.

 

4.         PUBLIC HEARINGS

 

A.     Variance Application #2007-1.  The applicant, Sherrie Wirth (Moondance), is requesting a variance from Section 16.72 of the Estacada zoning code, to allow a 3’ x 19’ sign on the front of the building.  The property is zoned C-1 (Commercial) and is subject to sections 16.28, 16.72 & 16.100 of the Estacada Municipal Code.  The property is described as 34E, 29AA, tax lot 2700 – 350 S Broadway Street. 

 

CP Hoelscher reviewed the staff report – which recommends denial because there are not any extraordinary circumstances that apply to this business vs. other businesses in the area. 

 

Sherrie Wirth, applicant stated that there are several other businesses on this same block that have large signs without having a variance.  She feels the trees in the downtown area are part of what makes it so cute, and doesn’t want to have to cut it down.  She feels it won’t be long before the tree in front of her business blocks a normal size sign. 

 

The Commission discussed the other signs and doesn’t feel they can compare this application to those signs.  They would like staff to check into whether those businesses have the required permits for their signs. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting.

 

Cm. James doesn’t feel we can make an exception for this business because we would set precedence. 

 

Cm. Anderson feels if there are other businesses not in compliance then the codes should be enforced.

 

Cm. Anderson moved to deny Variance Application #2007-1.  Cm. James seconded the motion.  Motion passed 4-0. 

 

B.      Partition Application #2007-2.  The applicant, Zachari Partridge, is requesting a two-lot partition of property described as 34E, Section 20, tax lot 1403, 627 NE 6th Avenue.  The subject property is zoned R-1. This application is subject to the criteria in Section 16.16, 16.104, 16.108, 16.116, 16.120 and 16.132 of the Estacada City Code. 

 

CP Hoelscher reviewed the staff report, which recommends approval with conditions. 

 

Zachari Partridge, applicant agreed with the conditions of approval.

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting.

 

Cm. James moved to approve Partition Application #2007-2 with the conditions in the staff report and modifying condition #2 & #11.  Cm. Hnidey seconded the motion.  Motion passed 4-0.
