MONDAY, AUGUST 13, 2007 - 7:00 PM

 

CALL TO ORDER BY PRESIDING OFFICER                                                                

 

The meeting was called to order at 7:00pm.  President Arnold led in the pledge of allegiance.

 

Present:  Cr. Becky Arnold, Cr. Brent Dodrill, Cr. Norm Ernst, Cr. Richard Hartwig, Cr. Kay Nelson, CM Randy Ealy, CR Denise Carey.

 

Absent:  Mayor Bob Austin, Cr. Michele Conditt.

Cr. Hartwig moved to approve the consent agenda.  Cr.  Dodrill seconded the motion.  The motion passed unanimously.

 

DEPARTMENT & COMMITTEE REPORTS                                                                  

 

Estacada School District Report – Howard Fetz, Superintendent – Mr. Fetz introduced Mary Whitney, School Board member, and Joe Gamble, Facilities Manager.  He feels a healthy relationship between the City and the school is very important.  He feels by working together, the City and school district can collaborate together toward a solution to their issues.  The council discussed the recent tagging problem with Mr. Fetz.  Cr. Dodrill asked about the weeds and unkept landscaping around Clackamas River Elementary.  Joe Gamble is working with Steve Shibley on a plan to improve and cleanup the landscaping around the elementary school with volunteers from the girl’s soccer team. 

 

Clackamas County Sheriff’s Office – Lt. Slaney – none.

 

City Recorder – Internal Control Report – CR Carey reviewed a memo regarding the internal controls with the City financial office and answered questions from the council.  Cr. Nelson commented about personal credit card purchases and would like to discourage the use of personal credit cards.  

 

City Manager – CM Ealy stated that 350 surveys were returned regarding the garbage and franchise service.  There will be a workshop on August 27th to review the surveys.  Within the next two weeks, the final lift of pavement will be placed on 4th Avenue.  The Wade Creek Park groundbreaking will be August 22nd at 11:00am.  The Council will meet August 20th at 6:00pm to approve the bid for construction services at the park.

 

PUBLIC HEARING – Ray Akre, 785 NE 6th Ave – Curb & Sidewalk Variance                            

 

President Arnold opened the public hearing and asked if any council member wished to abstain or declare ex-parte contact.  There was none.

 

PWD Randall reviewed his recommendation that the variance be denied and that a delayed site improvement agreement be completed stating that the property owner would be responsible for any curbs and sidewalks required once engineering plans are completed for that area.  This agreement would require the property owner install curbs and sidewalks if and when engineering requires them.

 

Cr. Arnold asked if the applicant would like to respond.  The applicant was not present.

 

In favor of:

Gary Warkentin, Coupland Road, stated that the topography in that area would create a financial hardship for the property owner to have to install curbs and sidewalks at this particular place on Coupland Road.  He does not feel that pedestrians would be safe on this corner even if there were a sidewalk.  There is a walkway on the other side of the road where it is safer.  He feels a variance should be granted to keep pedestrians off that side of the road.

 

Neutral:

Alan Rademacher commented that there is a pedestrian problem on the hill on both sides of the road.  He feels the walkway on the other side of the road is very dangerous too.  He would like to see a safe path to town along that road someday. 

 

Cr. Arnold closed the public hearing and asked for a motion.

 

Cr. Dodrill moved to deny the variance but have staff prepare a delayed site improvement agreement between the city and the property owner as discussed above.  Cr. Hartwig seconded the motion.   The motion passed unanimously.

 

 

 

COUNCIL BUSINESS                                                                                               

 

2007 Transportation System Master Plan – Ordinance Series of 2007, No. 4 – An Ordinance of the Estacada City Council adopting the Transportation System Plan. – Cr. Nelson moved to adopt Ordinance Series of 2007, No. 4 – An Ordinance of the Estacada City Council adopting the Transportation System Plan.  Cr. Ernst seconded the motion.  Roll call vote:  Cr. Arnold-yes, Cr. Dodrill-yes, Cr. Ernst-yes, Cr. Hartwig-yes, Cr. Nelson-yes.  The motion passed with 5 yes and 0 no.

 

Ordinance Series of 2007, No. 3 – An Ordinance amending and repealing sections of the Estacada Municipal Code.  CR Carey explained the amendments and deletions.  Cr. Hartwig moved to approve Ordinance Series of 2007, No. 3 – An Ordinance amending and repealing sections of the Estacada Municipal Code.   Cr. Nelson seconded the motion.  The motion passed unanimously.

 

Economic Opportunity Analysis Grant Application – CM Ealy reviewed the information in the packet and stated that this would update our comprehensive plan.  The council asked for more information.  CM will provide this at the next meeting.

 

Estacada Heath Care Survey – CM reviewed the memo regarding an Estacada Health Care Survey for $5,000 to determine health care needs in the Estacada area. 

 

Wastewater Treatment Headworks Project – Change Order Request – CR Carey explained the budget and the request.  Cr. Ernst asked how much contingency would be left.  CR stated there would be approximately $15,000 remaining.   Cr. Nelson moved to move ahead with the headworks project for $181,000.  Cr. Hartwig seconded the motion.  The motion passed unanimously.

COUNCIL REPORTS & COMMENTS                                                                          

 

Cr. Hartwig asked whom someone would contact if they receive the wrong ballot in an election?  CR Carey stated they should contact the Elections Office.

 

Cr. Ernst appreciated the workshop and tour of the Masonic Lodge.  He feels the owner is doing a great job by making improvements while keeping the historic value of the building.

 

Cr. Nelson enjoyed the tour also and thanked the boy scouts for attending the meeting tonight.

 

Cr. Arnold stated that there was a meeting for the Friends of Estacada Fire District to support the fire department and it was very well attended.  There will be another meeting August 21st.
