ESTACADA PLANNING COMMISSION MINUTES

THURSDAY, JANUARY 26, 2006 – 7:00 PM

1.         CALL TO ORDER

 

            The meeting was called to order at 7:00 pm.

 

2.         ROLL CALL

 

Present:  Cm. James, Cm. Sager, Cm. McGregor, Cm. Webber, Cm. Copeland, Cm. Crosby, Chrm. Cameron, CP McCallister, DCR Hovda.

 

Absent:  Cm. Crosby & Cm. Webber.

 

3.         APPROVAL OF DECEMBER 1, 2005 MINUTES

 

Consensus was to approve the minutes as presented.

 

4.         PUBLIC HEARINGS

 

A.       Comprehensive Plan Amendment Application #2004-2 & Zone Change Application #2004-2.  The applicant, Kenneth Corbett, is requesting a comprehensive plan map amendment from Commercial to Multi-family residential, and corresponding zone change from C-1 to R-3 for property described as 34E 20AB, tax lot 1200.  This application is subject to the criteria in section 16.24 & 16.101 of the Estacada Municipal Code and applicable policies in the City of Estacada Comprehensive Plan.  General Location:  34E 20AB, tax lot 1200 – NW Wade Street NW of its intersection with 10th Avenue.  A recommendation will be forwarded to the Estacada City Council.  The City Council will hold a public hearing on Monday, February 13, 2006, beginning at 7:00 pm in the Estacada City Council Chambers, Estacada, Oregon. 

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

CP reviewed the staff report, which recommends denial. 

 

Cm. Cameron read a statement regarding evidence. 

 

Kenneth Corbett, applicant explained that there is residential on all sides of this property and that Steve Mueller did a similar project just 500’ down the road. 

 

Terry McAulay, PO Box 400, Estacada, feels the location of this property and the surrounding residential homes justify the affordable housing this project would provide. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting.  The Commission deliberated. 

 

Cr. McGregor moved to recommend approval of Comprehensive Plan Amendment Application #2004-2 & Zone Change Application #2004-2 with the conditions in the staff report.  Cm. James seconded the motion.  Roll call vote:  Cm. James – yes, Cm. Webber – no, Cm. McGregor – yes, m. Sager – no, Cm. Cameron – yes.  Motion passed 3-2. 

 

B.       Subdivision #2005-6 & Variance #2005-2.  The applicant, Bill Frank (Byrd’s Nest Estates), is requesting a 30 lot residential subdivision for property described as 34E, 28BB, tax lot 100 and 34E, 21CD, tax lots 8600 & 8690, which are zoned R-1 (low density residential).  The applicant is also requesting a variance from Section 16.16.040 (A)(1), to provide for lot sizes ranging from 7,070 to 7,448 sq. ft. instead of the required 7,500 sq. ft minimum.  The application is subject to the criteria in Section 16.16, 16.104-16.116 & 16.100 of the Estacada City Code.  Upon recommendation by the Planning Commission, a final public hearing will be held by the City Council on Monday, February 13, 2006, at 7:00 pm in the Estacada City Council chambers.  General location:  585 SE 4th Avenue.

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

CP noted that just prior to the hearing tonight the applicant submitted a revised tentative plan, which is labeled as exhibit 4.  He reviewed the approved subdivisions in this area and showed how they connected to each other.  He reviewed the staff report, which recommends approval of the subdivision application with conditions.  CP explained that because they revised the tentative plan by narrowing Byrd Path Lane’s total right-of-way there is no longer a need for the variance application.

 

Cm. Cameron read a statement regarding evidence. 

 

Ken Diener, Architect on behalf of applicant withdrew variance request.  Explained that the applicant has worked with the neighboring property/developers and feels this should build out nicely.  He stated they don’t have any issues with the proposed conditions of approval. 

 

Chrm. Cameron explained to the audience how a decision is made and explained that they consider how this application meets Estacada codes, he asked that the audience direct testimony towards how it impacts the code, the Commission can’t deny something just because someone does or does not like.

 

Shannon Nickel, 576 SE 4th Avenue, is concerned with the building that is already going on in this area.  She stated that she and her neighbor have already been flooded by the sewer system.  She is also concerned with the steep slopes in this area.  She stated the Fire Department requires turn-arounds in each of these areas.  She feels it is already a freeway in front of her house and will only get worse.  She asked about the widening of 4th Avenue.  She asked if there would be sidewalks along both side of 4th Avenue.  Chrm. Cameron stated that each developer has to put sidewalks along their development, and none are being proposed on her (south) side of 4th Avenue. 

 

Kim Rutledge, 580 SE 4th, has been flooded 3 times this year because of the culvert.  She is also concerned with the speeding traffic along 4th Avenue/Regan Hill Road. 

 

Shannon Nickel, asked if there are any standards regarding roads and how much traffic is allowed on it.  Chrm. Cameron stated Regan Hill/4th Avenue would be designed to handle the amount of this traffic if fully built out.  He also explained that speed does not have anything to do with the development, but more with the Sheriff’s Department.

 

Mary Ann Floyd, 300 SE Ginseng, is concerned about the variance.  She has a 10,000’ lot along Ginseng.  She would like to see the developments more consistent with neighboring properties.  She would like to see them leave the Byrd Path Lane to remain 36’ wide – not narrow it just to cram another house into it.  She would like to speed bumps put along 4th Street to control the racing traffic on it.

 

Den Diener, discussed the lot sizes and the road widths.  He explained that 32’ is a good residential street.  Ginseng Street is 28’ wide, so it is wider than that.  He explained that wider streets sometimes encourage people to go faster.  He explained that the Fire Marshall has approved their turn-arounds. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting.  The Commission discussed the application. 

 

Cm. James asked if we have a legal issue regarding no access to the Mullins property if Phase I is developed and no other subdivisions are completed allowing access to their property. 

 

Chrm. Cameron reopened the public hearing.

 

William Frank, 6412 SE Sandy Blvd, Portland, applicant, is under contract with the applicant now and the applicant now owns the driveway.  Mullins access will be through Straightline Estates, which the applicant now has under contract as well. 

 

Chrm. Cameron closed the public hearing.

 

Cr. James moved to recommend approval of Subdivision #2005-6 with the revised conditions in the staff report adding a condition for sprinklers being required on houses above 12% grade on the road, and disregarding Variance Application #2005-2, which has been withdrawn.  Cm. Sager seconded the motion.  Roll call vote:  Cm. James – yes, Cm. Webber – yes, Cm. McGregor – yes, Cm. Sager – yes, Cm. Cameron – yes.  Motion passed 5-0.
