The meeting was called to order at 7:00pm. Mayor Austin led in the pledge of allegiance.

November Citizen of the Month – Rob
Gaskill & Tamara Pugh, Christmas Bazaar
Mayor Austin presented the November Citizen of the Month award to Rob Gaskill and Tamara Pugh.
Lt. Chuck Slaney, Clackamas County Sheriff’s Office, stated that the total number of calls is going downwards. There were no stolen vehicles or identity theft in the City in October. Criminal mischief went up slightly.

Cr. Nelson moved to adopt the consent agenda. Cr. Hartwig seconded the motion. The motion passed unanimously.
PUBLIC HEARING – ZONE
CHANGE/COMP PLAN AMENDMENT APPLICATION 2006-01
Mayor Austin opened the public hearing. He asked if any councilor wished to abstain
or declare exparte conflict. There was
none.
CP McCallister entered exhibit 22, email from Becky
Arnold, and exhibit 23, letter from Danny Scott, into the record. He explained that the application is requesting
the plan designation for 11.23 acres change from M1 Light Industrial to C1
Commercial. He explained the zone change
criteria including Oregon Administrative Rule No. 9. The applicant has submitted an Economic
Opportunity Analysis that, if approved, would become part of the Comprehensive
Plan. Exhibit 21 is a supplement to the
EOA. The Planning Commission found the
EOA was adequate to address the requirements of the Oregon Administrative Rule
and approved the application. The staff
report to the Planning Commission lists a number of reasons why staff does not
feel the EOA is adequate.
The next issue is the Transportation Planning
Rule. This development would have a
major affect on the TSP. There is a
traffic study provided with the application. The study evaluated the intersection of Hwy
224 & River Mill Road and Veteran’s Blvd & River Mill Road
intersection. Veteran’s Blvd/River Mill
Road intersection is OK. The
intersection of Hwy 224/River Mill Road will fail according to the study. Comments from ODOT and details in the traffic
study state if a signal were installed at the intersection, the intersection
would be OK. The signal would not be required until development occurs. The applicant has agreed to install the
traffic signal when it is required.
The last issue is in regards to a comprehensive plan
policy. Staff’s concern is that the
amount of traffic coming out of commercial property onto Veteran’s Blvd would
impede industrial traffic from the other side of the street. The Planning Commission did not think this
would be an issue.
Mayor Austin read the statement regarding evidence
and the right to appeal.
Mike Park, applicant, distributed three pages from
the agreement for the Special Public Works Fund money for building the infrastructure
in the area years ago. He stated 5 years
ago, there was not a need for commercial property like there is today. The town is growing and there is no place to
build retail. There is a need for
this. He agrees the River Mill Road/Hwy
224 intersection needs to be controlled or signaled.
Mayor Austin stated that the discussion of
industrial jobs vs. commercial jobs and family wage positions was a key factor
in the decision last time. He asked if
this had changed. Mr. Park stated that
there are many dollars lost in the community from people buying outside
Estacada.
Cr. Ernst asked who would handle the cost of the
traffic signal. Mr. Park stated that the
applicant would be required to install it but there would be SDC credits
available. Cr. Nelson asked who would
maintain the signal after it is installed.
CM Ealy stated that ODOT would maintain the signal.
Andy Pihl, partner with applicant, stated that on
page 29 of the EOA it shows a study of the surplus of industrial land that would
still be available if this zone change was approved. He also pointed out that the application is
consistent with all four goals as per the Planning Commission Findings and
Recommendation. He is requesting that
the approval would be contingent upon no occupancy or building permits issued
until the TSP is complete.
CM Ealy asked how the numbers were determined on
page 29 of the EOA when the applicant is also trying to bring in 150 acres of
industrial with the new comprehensive plan.
Mr. Pihl stated that the data was from the draft 2005 comprehensive plan
and the issue is the lack of commercial land.
Richard Berger, Planner and author of the EOA
analysis, stated that the final result comes from a formula that LCDC puts
together that looks at industrial jobs in the future. This report looks at historic trends of
employment to come up with the data.
In favor of:
Cliff Seubert, 1075 NW Park Avenue, stated that one
of the problems he is having with people he is hiring is that they want to live
close to the business but most of them are going to Clackamas or Sandy because
there is a lack of choice of commercial development such as clothing stores and
grocery stores. He feels that his work
force will double over the next few years and feels if there is more commercial
growth, people will build and live here.
Tom Stafford, 36532 SE Squaw Mtn. Road, stated that
commercial property is more appealing along the highway than industrial
property. The other cities around have
gone to the same thing by putting commercial along the state highways.
Steve Mueller, 25404 S McQueen Road, stated it is
time to get into the 21st century and is in favor of getting
something going out there.
Jason Guthu, 29653 SE Weitz Lane, stated we do need
more commercial to boost the economy in Estacada and to have jobs for the kids
in the community.
Tamara Pugh, 36250 SE Divers Road, stated that
trying to revitalize downtown has constantly hit brick walls and she feels
bringing competition to town will help the economy. This will broaden the tax base to help our
schools and our city.
Courtney Lewis, 21219 S Springwater Road, stated
that people do not buy in Estacada but they go to Clackamas and Sandy for their
shopping. He asked the council to think
towards the future and to allow this property to be developed as
commercial.
Terry McCauley has lived in Estacada for 35 years
and use to be anti-growth. He feels we
need commercial development in Estacada and he feels this area would be a good place
for commercial development. This
opportunity would make Estacada a complete town.
Alan Rademacher, 30735 SE River Mill Road, feels
that commercial should be on that corner.
Commercial activity on the highway would enhance the downtown businesses
and bring high paying jobs.
Phyllis Brinkley, 26609 SE Turford Lane, is in the
real estate business and she feels this zone change will boost the economy of
Estacada.
Neutral:
Clinton Vining, President of Chamber of Commerce,
stated they are definitely for progress and growth.
In opposition:
None.
Cr. Hartwig asked about the 4200 possible trips on
Veteran’s Blvd and how this will affect the semi traffic. He asked if there was parking allowed on this
street. Mr. Park was not sure about
this.
Mayor Austin stated there are many Estacada Rock
trucks using River Mill Road and wondered how would the commercial traffic
affect them. Mr. Park stated that a
signalized intersection would make it much safer than it is now for these
trucks.
Cr. Hartwig asked CP McCallister if this would set a
precedent for the city if passed. CP
McCallister stated each application would be considered individually and
evaluated on its merits.
Cr. Erickson asked how much staff is concerned with
the adoption of the new EOA. CP
McCallister stated he has some concerns of the EOA as it concerns the expansion
of the Urban Growth Boundary to bring in more industrial property. CP McCallister’s concern is that the EOA that
would be adopted would make it hard to adopt any extra industrial land in the
UGB in the future because of the information in the EOA (requiring only 13
acres of industrial land). The
information in the EOA refers to the Comp Plan review currently happening that
is in a very preliminary stage. You have
to be careful about relying on assumptions in this plan update because there
are a lot of things that have not been decided.
Cr. Nelson stated that we do need commercial but
does not want to give up the light industrial that we have.
Mr. Park believes that there is a tremendous need
for commercial and hopes the council will support the application.
Mayor Austin closed the public hearing.
Cr. Ernst moved to approve Zone Change/Comprehensive
Plan Amendment 2006-01 with the conditions in the Planning Commission recommendation
and with a condition that no building permits be issued until the traffic light
is installed. Cr. Nelson seconded the
motion. The Council discussed the
motion. Roll call vote: Cr. Nelson-yes,
Cr. Hartwig-yes, Cr. Ernst-yes, Cr. Erickson-yes, Mayor Austin-yes. The motion passed with 5 yes and 0 no.

REPORTS
City Recorder – November 7, 2006 Election Results – CR Carey read the certified election
results.
City Manager – CM Ealy reported on the status of the Wade Creek Park Project, 4th
Street Alignment project and tri-met.
Mayor Austin informed the council that there would be a media event at the capitol on January 3, 2007 hosted by the League of Oregon Cities and the Oregon Mayors Association. The purpose is to kick off the 2007 legislative session with a strong message to Oregonians that city and state governments can work together to make our communities great places to live, visit, work and play.

to the Parks & Recreation Commission with consent of the council.

Cr. Hartwig thanked the Planning Commission,
volunteers, Mike Park and Andy Pihl, and all the citizens that participated
tonight.
Cr. Ernst thanked all the citizens that contributed
tonight and thanked Ben Erickson for his service to the city.
Cr. Nelson thanked Ben for always having the right
questions and thanked him for all he did for Estacada.
Cr. Erickson thanked all the citizens that
participated tonight. He thanked Chris,
staff and Randy for helping him along the way.
He read a statement about his last few years on the council.
Mayor Austin stated that the council has made many
good decisions and will continue to do what is best for this community.
