ESTACADA PLANNING COMMISSION MINUTES

THURSDAY, JULY 21, 2005 – 7:00 PM

CITY HALL

 

1.       CALL TO ORDER

 

The meeting was called to order at 7:00 pm.

 

2.       ROLL CALL

 

Present:  Cm. James, Cm. McGregor, Cm. Webber, Cm. Sager, Cm. Copeland, Chrm. Cameron, CP McCallister, DCR Hovda.

 

Absent:  Cm. Crosby.

 

3.          APPROVAL OF JUNE 16, 2005 MINUTES

 

          Consensus was to approve the minutes as presented (Cm. Sager abstained).

 

4.          PUBLIC HEARINGS

 

A.    Annexation application #2005-01. The applicant, Leroy Forman (D.J. Bleu) is requesting annexation of property described as 34E 17, tax lot 1900 & 17D, tax lots 400, 402, 500, 600, 700, 800, 900, 1000, 1400, 1500, & 1501 into the City limits of Estacada. The application includes a corresponding zone change from RRFF-5 (county designation) to M-1 (light industrial), consistent with the Estacada Comprehensive Plan. The property is located east of Eagle Creek Road at River Mill Road. The application is subject to the criteria in Section 16.36 and 16.124 of the Estacada City Code and applicable policies in the Estacada Comprehensive Plan. 

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

CP reviewed the staff report, which recommends approval with conditions.

 

Cm. Cameron read a statement regarding evidence. 

 

DJ. Bleu, on behalf of applicant, feels based upon the current City traffic study the roads are sufficient – there are no roads close to failing.  He agrees with the conditions of approval.

 

Scott Henderson, 26985 SE Currin Road, Estacada, feels that if the applicant has been working on this project since 1975 then that sends a bad message to new property owners.  He supports the project if it does provide low-income housing. 

 

Marcie Forman, 21995 A Sandlake Road, Cloverdale, OR, Trustee of the Leroy Forman Trust, expressed the lifetime goal of Mr. Foreman to provide the much needed housing needs of the community.  She feels the application is complete and asked the City support it. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting. 

 

Cr. James moved to recommend approval of Annexation Application #2005-1 with the conditions in the staff report.  Cm. Sager seconded the motion.  Roll call vote:  Cm. James – yes, Cm. McGregor – yes, m. Sager – yes, Cm. Copeland – yes, Cm. Cameron – yes.  Motion passed 5-0. 

 

 

B.        Annexation application #2005-02. The applicants, Robert & Juanita McLain, and Liz Meyers are requesting annexation of property described as 34E, 16, tax lots 600, 700, 1200 & 1201, and 34E, 21, tax lot 402 (the westerly 1,695’ x 50’ wide strip) into the City limits of Estacada. The application includes a corresponding zone change from RRFF-5 & EFU (county designation) to R-1 (low density residential – 7,500 sq. ft. lot size), consistent with the Estacada Comprehensive Plan. The property is located east of Cemetery Road, north of it’s intersection with Hill Way. The application is subject to the criteria in Section 16.16 and 16.124 of the Estacada City Code and applicable policies in the Estacada Comprehensive Plan. 

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

CP reviewed the staff report, which recommends approval with conditions.

 

Cm. Cameron read a statement regarding evidence. 

 

Robert McLain, 32840 SE Duus Road, have lived on this property for over 45 years and feel it’s time for a change. 

 

Don Oakley, Cascade Communities, proposing 154 acre annexation, 4 different ownerships and 5 different tax lots.  He explained the proposed future development plans for the area and the infrastructure layout possibilities.  He explained that they have an agreement with Mr. & Mrs. Veley to purchase their 50’ portion of the flaglot that is being annexed. 

 

Steve Phifer, land use attorney with offices at 1120 NW Couch, Portland, 97204, discussed a few of the procedural issues regarding notice not being provided to a couple of the property owners within the area.  He reminded the group that they are the first of two hearings and with re-notification before the second hearing the City is more than covered.  Therefore, there is no procedural error.  Measure 56 requires notice to the affected property owners, which is only the 5 tax lots that are applying.  He stated they are very much aware of the zone change and potential change in the values.  He also discussed the agency notification and stated that they have already commented, which means that they have already had at least 21 days notice, possibly more. 

 

Bob Veley, 33700 SE Duus Road, Estacada, informed Mr. Oakley and the Commission that the issue of non-notification is not an issue to him.  He just wanted to point out the error for future issues. 

 

Mr. Oakley further discussed issues relating to his development including transportation issues.  Mr. Oakley agrees with the conditions of approval.

 

Steve Mueller, 25404 SE McQueen Road, Estacada, excited to be a part of this project and feels Estacada will benefit from Mr. Oakley’s development.

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting. 

 

Cr. James moved to recommend approval of Annexation Application #2005-2 with the conditions in the staff report.  Cm. Copeland seconded the motion.  Roll call vote:  Cm. James – yes, Cm. McGregor – yes, Cm. Sager – yes, Cm. Copeland – yes, Cm. Cameron – yes.  Motion passed 5-0. 

 

C.       Ordinance #2005-1 - amends the city code dealing with planned developments – clarifies the requirements and procedures and reduces open space to 20%. 

 

Cm. Cameron feels that developers shouldn’t have to have something unusual or unique about their property such as topographical issues.  He feels it should apply to anyone that wants to use it.  The whole idea of this ordinance is to allow more flexibility.  Then the City still has the authority to look at proposals on an individual basis. 

 

The Commission changed the open space requirement to 20%.

 

Mr. Oakley feels the ordinance provides some great flexibility that can really be used for future development. 

 

The group feels no minimum lot sizes should be required in order to remain as flexible as possible.  This would allow row houses, etc.

 

The group agreed on proposed changes that CP will incorporate into the draft ordinance and forward it to City Council for their review.
