ESTACADA PLANNING COMMISSION MINUTES

THURSDAY, DECEMBER 1, 2005 – 7:00 PM

CITY HALL

 

1.       CALL TO ORDER

 

          The meeting was called to order at 7:00 pm.

 

2.       ROLL CALL

 

Present:  Cm. James, Cm. Sager, Cm. McGregor, Cm. Webber, Cm. Copeland, Cm. Crosby, Chrm. Cameron, CP McCallister, DCR Hovda.

 

3.       APPROVAL OF SEPTEMBER 22, 2005 MINUTES

 

Consensus was to approve the minutes as presented.

 

4.       PUBLIC HEARINGS

 

A.       Subdivision #2005-5 - The applicant, Crest Power Equipment, Inc. (Steve Mueller), is requesting a 18 lot residential subdivision for property described as 34E, 21CB, tax lot 100, which is zoned R-1 (low density residential).  The application is subject to the criteria in Section 16.16, 16.104-16.116 of the Estacada City Code.  Upon recommendation by the Planning Commission, a final public hearing will be held by the City Council on Monday, January 23, 2006, at 7:00 pm in the Estacada City Council chambers.  General location:  SE corner of the Shafford Street and 6th Avenue intersection.   

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

CP reviewed the staff report, which recommends approval with conditions. 

 

Cm. Cameron read a statement regarding evidence. 

 

Steve Mueller, applicant, 25404 S McQueen Road, Estacada, existing structures will come down and existing house will stay.  Tried to utilize the lay of the land with minimal impact to the creek.  He concurs with the staff report and conditions of approval. 

 

Cm. Webber is concerned with parking and directing traffic in the cul-de-sac.  Mr. Mueller is not against parking in the middle or just parking between driveways.  Cm. Webber is also concerned with the depth of the sewer in some of the lots.  Mr. Mueller stated some of the lots could end up with their own pumps up to the manhole. 

 

Cm. McGregor asked about doing the improvements along Carol Street.  Mr. Mueller stated he is not against improving that street, and he understands that he would be eligible for SDC credits if he did. 

 

Jerry Polzin, 450 NE Carol Street, neighboring property owner, would like to see the speeds down on NE Carol.  He feels that to keep the speeds down he would like to see the sidewalk continued down the south side of Carol and Oakview and not on the north side.  He feels this would make it safer for pedestrians.  Otherwise he does not have any problems with Mr. Muellers proposal.  Mr. Polzin is not sure if his driveway extends into the right-of-way or not because there was not a survey done when he purchased his property.  He would like the City to take this into consideration and not make the street full width in that area if it would mean taking part of his driveway and making it so he could not park in his driveway.

 

The Commission discussed the request to only have sidewalks on the south side and feels that most pedestrian traffic would be students out of the cul-de-sac and feels that if they come out of that area they would want to travel on the north side of the road – which is also on the side of the school. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting.  The Commission discussed the application. 

 

Cr. James moved to recommend approval of Subdivision Application #2005-5 with the conditions in the staff report.  Cm. Sager seconded the motion.  Roll call vote:  Cm. James – yes, Cm. Webber – yes, Cm. McGregor – yes, m. Sager – yes, Cm. Copeland – yes, Cm. Crosby – yes, Cm. Cameron – yes.  Motion passed 7-0. 

 

B.        Similar Use Application #2005-1.  The applicant, Cascade Utilities, is requesting permission to erect a Simulsat satellite dish at 273 SW Zobrist Street.  The placement of this dish is intended for Cascade Cable to continue providing cable television service to the city and its surrounding customers.  The subject property is zoned C-1 (commercial).  Section 16.04.030(e) which allows authorization of similar use in a particular zone provided the proposed use is compatible with the current use.  The application is subject to the criteria in Section 16.040.030(e) & 16.28 of the Estacada City Code.  General location:  34E, 29AA, tax lot 6100.

 

Cm. Cameron opened the public hearing and asked for abstentions or exparte contact, there was none.

 

Cm. Crosby declared a conflict of interest and stepped down from the meeting. 

 

Cm. Sager declared ex-parte contact because he has discussed the application with an employee of the applicant. 

 

CP explained it wasn’t clear if the code allowed for this type of use outright, so CM and CP decided it should be considered by the Commission in a public hearing.  CP reviewed the staff report, which recommends conditions. 

 

Cm. Cameron read a statement regarding evidence. 

 

Dennis Anderson, on behalf of the applicant, 789 NE Edgehill Drive, stated the applicant concurs with the staff report.  He stated they had satellite dishes at this location in the past and they didn’t forsee having to go through this process and are really in a rush for approval because they have to have it in place by the end of this year.  He handed out drawing of the placement of the dish and what the view would be by adjacent properties. 

 

Chrm. Cameron closed the public hearing and reopened the Planning Commission meeting. 

 

Cr. Webber moved to recommend approval of Similar Use Application #2005-1 with the conditions in the staff report.  Cm. Copeland seconded the motion.  Roll call vote:  Cm. James – yes, Cm. Webber – yes, Cm. McGregor – yes, m. Sager – yes, Cm. Copeland – yes, Cm. Cameron – yes.  Motion passed 6-0.

          The meeting was adjourned at 8:00 pm.
