1. CALL TO ORDER
The meeting was called to order at 7:00 pm.
2. ROLL CALL
Present: Cm. Allen Cameron, Cm. Don McGregor, Cm. Brenda Crosby, Cm. Tom Sager, Cm. Richard Hartwig, Cm. Jeff Copeland, CP Mike McCallister, CP Mark Green-Hite, CR Denise Carey.
3. APPROVE MINUTES OF THE JUNE 24, 2004 MEETING
Consensus was to approve the minutes as presented.
4. PUBLIC HEARING
Chrm.
Cameron opened the public hearing and asked for abstentions or ex-parte
contact. Cm. Sager stated he had looked
at the site but talked to no one. There
were no other declarations.

McCallister reviewed the staff report, which recommends approval with
conditions.

Cameron read a statement regarding evidence.
Gunther
Goos, 544 NE Carol Street – Mr. Goos is not afraid of growth but is concerned
about the traffic on Carol Street. He
would like to see Carol Street improved.

Cameron closed the public hearing and opened the Planning Commission meeting.
Cm.
Hartwig moved to recommend approval of Annexation application #2004-01 and Zone
Change application #2004-01 to the City Council. Cm. Copeland seconded the motion. Roll Call Vote: Cm.
Hartwig – yes, Cm. Sager – yes, Cm. Copeland – yes, Cm. McGregor – yes, Cm.
Crosby – yes, Chrm. Cameron – yes.
Motion passed 6-0.
B. Annexation application #2004-02 and Zone Change
application #2004-02. The City of Estacada has initiated an application to
annex the property described as 34E 21CB, tax lots 2900 & 2903 and 34E 21C
tax lot 1501 into the City limits under the island annexation provisions of the
City Code. The application also includes a zone change request from RRFF-5
(County designation) to R-1, consistent with the Estacada Comprehensive Plan.
The property is located on the east side of Ginseng Drive, approximately 350'
south of its intersection with NE Carol Street. The application is subject to
the criteria in Section 16.16, 16.101 and 16.124 of the Estacada City Code and
applicable policies in the Estacada Comprehensive Plan.

D. Subdivision application #2004-2. The applicant, Ross Smith (Devey Estates),
is requesting a 6 lot residential subdivision for property described as 34E,
21C, tax lot 1401, which is zoned R-1 (low density residential). The application is subject to the criteria
in Section 16.16, 16.104-108 and 16.116 of the Estacada City Code. The property is located east of the terminus
of Oakview Lane.

Cameron opened the public hearing and asked for abstentions or ex-parte
contact. There was none.

Green-Hite reviewed the staff report, which recommends approval with
conditions. He entered Exhibit 8 into
the record with the signature of approval by a second owner.

Green-Hite received a phone call from ??????? who was concerned that Oakview
Drive and Carol Street is too narrow to support the additional traffic from
this subdivision proposal. She also
feels the water pressure is low already and the additional houses would affect
others. She also was concerned with the
landscaped island on Oakview.
CP
Green-Hite reviewed the conditions in particular that deal with the street
improvements required, water pressure and storm drain issues. He stated that Public Works said that the
water pressure (28 lbs) exceeds state minimums (20 lbs) and that the additional
housing would not affect the pressure of other users.

Cameron read a statement regarding evidence.
Randy
Devey, applicant – Mr. Devey stated that Carol Street already services the
homes on Oakview Drive and he feels the additional six houses could be
adequately served by Carol Street too.
He is aware of the water pressure issue, sewer issue and the flag lot
25’ stem issue and will be willing to work with the city to solve all of these
issues.
Susie
Isaacson, 402 NE Oakview Drive – Ms. Isaacson supports this development but
wants to be sure that after this property is developed no others are approved
because Carol Street is so narrow. She
loves the area and feels it is very beautiful.
Chris
Fisher, 375 NE Oakview Drive – Mr. Fisher is concerned with the water pressure
issue and the congestion issue. He
feels that doubling the traffic would be insane on these inadequate streets and
feels they should be upgraded before any other houses are built. He is not against the development but would
like the streets brought up to adequate standards.
Gary
Warkentin, 32795 Coupland Road – Mr. Warkentin objects that the storm water
from two of the lots will go into Wade Creek.
Mr.
Devey stated that there will be storm water systems or dry wells put on site
for these properties so the storm water will not enter the Estacada storm drain
system.
Chrm.
Cameron feels the removal of the island on Oakview Drive should be a condition
of approval. Mr. Devey agrees and has
no problem with this.
Chris
Fisher, 375 NE Oakview Drive – Mr. Fisher clarified that the roadway accessing
the area is what he was addressing previously.
Gunther
Goos – Mr. Goos asked the commission to take time to visit Carol Street and
take a look at how inadequate it is. He
is not against the development but feels the road should be improved.
Bill
DeWynn, Oakview Drive – Mr. DeWynn is not against this development but does not
want to see anymore without street improvements.
Cm.
McGregor guaranteed that no more houses would be approved without some major
street improvements.
Susie
Isaacson – Mr. Isaacson stated that there is some property for sale above this
property and this is what they do not want developed without street
improvements.

Cameron closed the public hearing and opened the Planning Commission meeting.
The
Commission discussed the issues. Cr.
Sager commented on adding the condition to remove the island and asked staff
how this can be added as a condition since the island is not owned by the
applicant. CP Green-Hite stated that it
is public right-of-way so the applicant can remove the island. Cm. Crosby asked about improving the 17-foot
area to 25 feet. CP Green-Hite stated
that there could be questions as to where the current paving is in the
right-of-way and whether the developer should be responsible. This is a question that the Planning
Commission must answer.
Cm.
McGregor moved to recommend approval of Subdivision application #2004-2 with
conditions, adding a condition to remove the cul-de-sac island, adding a
condition to pave to the improved area of Oakview Drive and recommends to city
council that they look at the 17’ paved area accessing the area and make
recommendations to the contractor if improvements can be financially
feasible. Cm. Hartwig seconded the motion. Roll Call Vote: Cm. Hartwig – yes, Cm. Sager – no, Cm. Copeland – yes, Cm.
McGregor – yes, Cm. Crosby – yes, Chrm. Cameron – yes. Motion passed 5-1.
E. Subdivision application #2004-3. The applicant, Ainsworth Partners, is
requesting a 4 lot residential subdivision for property described as 34E, 28B,
tax lot 1800, which is zoned R-1 (low density residential). The application is subject to the criteria
in Section 16.20, 16.104-108 and 16.116 of the Estacada City Code. The property is located on the south side of
Darrow Road, west of its intersection with Regan Hill Road.

Cameron opened the public hearing and asked for abstentions or ex-parte
contact. There was none.
CP McCallister stated that the applicant has requested a postponement until the next meeting, August 26, 2004.
Cm. Crosby moved to postpone the public hearing until August 26, 2004. Cr. Copeland seconded the motion. The motion passed unanimously.
Chrm. Cameron closed the public hearing until August 26, 2004.
