ESTACADA PLANNING COMMISSION MINUTES

CITY HALL

FEBRUARY 26, 2004 – 7:00 PM

 

 

1.         CALL TO ORDER

 

            The meeting was called to order at 7:00 pm.

 

2.         ROLL CALL

 

Present:  Cm. McGregor, Cm. Copeland, Cm. Sager, Cm. Hartwig, Chrm. Cameron, CP McCallister, DCR Hovda.

 

Absent:  Cm. Crosby.

 

3.         APPROVE MINUTES FO THE JANUARY 29, 2004 MEETING

 

Consensus was to approve the minutes as presented (Cm. Sager abstained).

 

4.         PUBLIC HEARING

 

  1. Land Partition Application #2004-1 - The Applicant, Chris Liu (EBS Trust), is requesting a three-lot partition of property located on the SE side of Cemetery Road, aprox. 200 feet north of Hill Way, and described as 34E, Section 21, tax lot 400.

 

Cm. Camerom asked for abstentions or exparte contact – there was none. 

 

CP McCallister reviewed the history of previous applications, current status of the project and the staff report, which recommends approval, with conditions.  Cm. Cameron read a statement regarding evidence. 

 

Tom Sisul, Sisul Engineering, representing applicant, feels that condition #2 is a strange condition for this application.  He feels in order for the City to sign off on one phase of this development would require the developer to bond the entire project.  He would like to see the condition changed to say that it has been reviewed and approved by the City, but not signed.  This would allow Mr. Lui to obtain funding.  CP stated the City’s intent is to do the review and if all of the conditions of the original approval are met, the City would sign off on it.  Mr. Sisul stated that he would like to have this partition plat recorded so he can get his funding, but the bonds will not be in place until after financing is obtained.  CP asked if Mr. Lui intends to bond for the entire project or is he going to do some on site construction before he records the plat.  CP stated his concern is in this partition application we would normally include road dedications and road improvements, particularly on Cemetery Road.  CP did not require those.  Mr. Sisul recommends requiring the Cemetery Road improvements and/or bonding with the partition application instead of the condition #2. 

 

Cm. Hartwig is asked if this partition is the applicants attempt to start the project.  Mr. Sisul stated that it is. 

 

Bob Veley, 33700 SE Duus Road, discussed a couple of discrepancies between the first and second proposals, including a 50’ wide easement along Mr. Veley's property that was vacated over a decade ago.  CP stated that the easement still shows up on the most current county documents.  Also at the time the plat was approved in 1999 the County and State were reviewing a state mandated airport overlay zone that has since been adopted. 

 

Chrm. Cameron closed the public hearing and reopened the regular meeting.

 

Cm. Hartwig asked PWD Randall if there are any problems with getting this project started.  PWD Randall stated the biggest concern is the Cemetery Road alignment.  There is a pump station that is going to go in on the property later to deal with future development. 

 

Cm. McGregor moved to approve Land Partition Application #2004-1 with the conditions in the staff report, and the modification of condition #2 to include the right of way dedication along Cemetery Road and improvements along Cemetery Road that are consistent with the approval by the City Council from 1999.  Cm. Copeland asked if we need to mention the airport overlay zone.  Cm. McGregor stated that we do not because it has not been adopted by the City and is not a part of this application. Cm. Hartwig seconded the motion.  Roll Call Vote:  Cm. McGregor – yes, Cm. Copeland – yes, Cm. Sager – yes, Cm. Hartwig – yes, Cm. Cameron – yes.  Motion passed 5-0.
