MONDAY, September 27, 2004 - 7:00 PM

 

CALL TO ORDER BY PRESIDING OFFICER                                                                

 

The meeting was called to order at 7:00 pm.  Mayor Austin led in the pledge of allegiance.

 

Present:  Cr. Marli Stauffacher, Cr. Cliff Atkinson, Cr. Michele Conditt, Cr. Ben Erickson, Cr. Gavic (arrived at 7:15 pm) Mayor Robert Austin, CM Randy Ealy, DCR Traci Hovda.

 

Absent:  Cr. Arnold, CR Denise Carey.                                         

 

CITIZEN AND COMMUNITY GROUP COMMENTS                                   

September Golden Rake Award – Cazadero Inn

 

Mayor Austin presented Sam Dunlop with the September Golden Rake Award.

 

CONSENT AGENDA                                                                                                

Approve September 13, 2004 Council minutes

 

Cr. Erickson moved to approve the consent agenda.  Cr. Atkinson seconded the motion.  Motion passed unanimously.

 

COUNCIL BUSINESS                                                                                                        

 

Municipal Judge Appointment – This issue was tabled until the next meeting to allow staff adequate time to contact the current Judge and the applicant.

 

Estacada Family Resource Center Funding request – ECF Grant - CM Ealy recommended approving this request contingent upon complete funding being secured.  Cr. Conditt stated that she has seen how worn out the carpet is in this facility and agrees that it does need replaced.  CM feels that it is a hazard for some of the elderly that visit the building.  Cr. Erickson would still like to have clarification on the Community Center agreement, specifically regarding who receives rent payments from the Resource Center and what that money is used for.  He does feel this is a great way to support the Community Center. 

 

Cr. Conditt moved to approve the request to use general fund money to help the Community Center replace carpeting contingent upon the Community Foundation funding the remainder of the project.  Cr. Erickson seconded the motion.  Roll Call Vote:  Cr. Stauffacher–yes, Cr. Atkinson–yes, Cr. Conditt–yes, Cr. Gavic–yes, Cr. Erickson–yes, Mayor Austin–yes.  The motion passed with 6 yes and 0 no.  Staff will keep Council posted if matching funds are obtained. 

 

Resolution 2004 – 17 – A resolution of the Estacada City Council opposing the passage of Measure 37, that if passed by Oregon voters in November 2004, requires governments to pay property owners, or forgo enforcement, when certain land use restrictions reduce property value. 

 

Mayor Austin briefly reviewed the material in the packet and the impact of the measure.  He feels that we should go on record as opposing this measure since it has the potential of costing the City money. 

 

Cr. Gavic is concerned about not seeing both sides of the measure before making a decision.  Mayor Austin stated that one of the documents is from the Oregon Department of Revenue and it clearly states what impact it will have on cities.  Mayor Austin stated that he is not in a hurry to pass the resolution and that council can take time to review and then make a decision.

 

Cr. Erickson does not feel comfortable supporting or opposing a measure as council business therefore, he will abstain from any vote on this issue.  Mayor Austin explained that several cities have chosen to make a statement when it comes to something that impacts their city such as this measure. 

 

Cr. Conditt understands Cr. Erickson’s concerns, but feels that voters will look to their leaders for help in making a decision therefore, opposing something like this that could have such an impact on the city is appropriate.   

 

Cr. Atkinson moved to approve Resolution 2004-17 - A resolution of the Estacada City Council opposing the passage of Measure 37, that if passed by Oregon voters in November 2004, requires governments to pay property owners, or forgo enforcement, when certain land use restrictions reduce property value.    Cr. Resolution 2004 – 18 – A resolution establishing a 2005 Centennial Committee for the City of Estacada. 

 

CM stated there are a few people in attendance tonight that are working on key parts of this event.  Cr. Conditt moved to approve Resolution 2004-18 - A resolution establishing a 2005 Centennial Committee for the City of Estacada.    Cr. Erickson seconded the motion.  The motion passed unanimously.  Mayor Austin would like people to contact him to be appointed to the committee. 

 

DEPARTMENT & COMMITTEE REPORTS                                                                  

 

CM announced that he was engaged to Sarah Eli.  The council congratulated CM. 

 

CM discussed the ribbon cutting ceremony last week regarding the Main Street paving project.  The project was on time and under budget.  He also stated that the city has purchased the property along the 4th street right of way.  The Fire Department is considering it for a “burn and learn” project.

 

CM attended a meeting all day today regarding PGE’s relicensing agreement, which includes potential future uses of Timber Park.  Part of this discussion is the possibility of making the portion of the Clackamas River from River Mill Dam up to Cazadero a non-motorized use only of the river.  This would allow PGE to improve the trail system along Lake Shore and provide for better access off of Lake Shore.  The Council discussed the proposal and feels that the benefits of improving the Lake Shore area are definitely worth it. 

 

Cr. Gavic asked what opportunity motorized boaters have for voicing their concerns.  He feels these recreational users would be greatly concerned about losing this use. 

 

Cr. Conditt would like everyone to start thinking about a date in January when the Council can get together and review their goals, especially with the new members that will be coming on board. 

 

Estacada will be hosting the Clackamas Cities dinner in October.  Mayor Austin has suggested using the Clackamas River Elementary as the location.   He suggested having David Bugni speak regarding the school master plan as well as the library bond measure that is on the ballot. 

 

CITIZEN AND COMMUNITY GROUP COMMENTS                                             

 

Irene Adams, 30333 SE Cemetery Road, complimented the City on the roadwork on Main Street.  She feels they did a fast, fabulous job.  Mayor Austin feels that Public Works also did a great job keeping the businesses and citizens involved and informed during this project. 

 

COUNCIL REPORTS & COMMENTS                                                       

 

Cr. Gavic congratulated the Centennial Committee.  He stated that when given the chance he has some questions regarding the Judge position. 

 

Cr. Conditt stated that the Library Foundation is working hard to get information out regarding the library measure and asked everyone to support them on the ballot in November. 

 

Cr. Atkinson asked if staff has reviewed the idea of funding an in-house planner.  He would like to see this addressed in the near future.  He also mentioned the upcoming Community Center casino night in mid-October. 

 

Mayor Austin thanked Phil Lingelbach for his hard work on the Best Dam Run – he feels that it was a great event and well attended.  He discussed several recent and upcoming events in and around Estacada.  He reminded the Council that the League of Oregon Cities conference will be in Portland this November and recommended that they all register soon.
