Mayor
Austin called the meeting to order at 6:00 pm.
Present: Cr. Cliff Atkinson, Cr. Michele Conditt (6:45), Cr. Becky Arnold, Cr. Ben Erickson, Mayor Robert Austin, CM Randy Ealy, CA Andrew Cole, CR Denise Carey.
Absent: Cr. Marli Stauffacher, Cr. Cliff Gavic.
COUNCIL BUSINESS
Ballot
Measure 37 Process Ordinance – CM
reviewed some of the ways other agencies have handled the ballot measure and
reviewed the handouts.
CA
reviewed the model ordinance and the basic procedure included in the
ordinance. Some communities are writing
in a “private right of action” that allows neighbors to sue an applicant if
their proposal negatively impacts the fair market value of the neighbor’s
property.
CA
stated that a measure 37 claim is most likely going to be attached to a
development claim.
The
council discussed the processing fee. CR
explained current land use fees and that an average land use application that
requires a public hearing is $500.
The
Council and staff reviewed the ordinance and made changes.
CM
Ealy read the first reading of Ordinance Series 2004, No. 4 – An ordinance
concerning real property compensation; adopting procedures for processing
claims; declaring an emergency; and providing for an immediate effective date.
Cr.
Arnold moved to dispense with the second reading and read by title only. Cr. Atkinson seconded the motion. The motion passed unanimously.

Cr.
Atkinson moved to adopt Ordinance Series of 2004, No. 4 – An ordinance
concerning real property compensation; adopting procedures for processing
claims; declaring an emergency; and providing an immediate effective date. Cr. Conditt seconded the motion. The motion passed unanimously.
Resolution
2004 – 20 – A Resolution of the
City of Estacada, setting a processing fee for all Ballot Measure 37 real
property compensation claims.
Cr.
Arnold moved to adopt Resolution 2004 – 20 – A Resolution of the City of
Estacada, setting a processing fee for all Ballot Measure 37 real property
compensation claims. Cr. Erickson
seconded the motion. The motion passed
unanimously.
Library
Building Letter of Intent – CA Cole
reviewed the letter of intent confirming that the City has taken substantial
steps toward completion of a new library facility. He explained the need for such a letter for
the Clackamas County Board to be able to proceed with the funding of the project. This is a mandatory first step of the
process.
The
council had no questions and approved of the letter.
