The
meeting was called to order at 7:00 pm.
Mayor Austin led in the pledge of allegiance.
Present: Cr. Cliff Atkinson, Cr. Michele Cheshier,
Cr. Becky Arnold, Cr. Marli Stauffacher, Cr. Ben Erickson, Cr. Cliff Gavic,
Mayor Bob Austin, CM Randy Ealy, CA Andrew Cole, CR Denise Carey.
CITIZEN AND COMMUNITY GROUP
COMMENTS
Carl Solomon, 850 NE Hill Way – Mr. Solomon has
heard that there is concern that there are too many murals in town. He believes that the murals have been
stimuli in which Estacada has changed its public appearance to a more positive
connotation. He stated that the Artback
group has done the murals without much help from the city and are a civic
organization that has made a positive impact on Estacada. He encouraged the council to be careful of
what they say publicly about the murals.
He asked the council to support the 1% for art.
Suzanne Dinsdale, Estacada Arts Commission – Ms.
Dinsdale read a handout distributed to the council.
Jane Reid, Estacada Arts Commission & Clackamas County Arts Alliance – Ms. Reid stated that it is not fiscally irresponsible for the council to adopt this ordinance. She also feels passing this ordinance will make a strong statement for the arts in Estacada. She stated there are times when things come together and the time in Estacada is now.

March 22, 2004 Council minutes
Cr. Erickson moved to approve the March 22, 2004 minutes. Cr. Arnold seconded the motion. The motion passed unanimously.
DEPARTMENT & COMMITTEE
REPORTS
Clackamas County Sheriff’s Report – Lt. Slaney
reviewed the 2003 Annual report and the January and February activity
reports. He also informed the council
that you have to be 16 and wear a helmet to ride a motorized scooter. They are to follow the same rules as
bicycles and motorcycles and only one person can be on the scooter. ORS 814.512 is where you can find the
regulations regarding motorized scooters.
City Manager – CM Ealy reviewed his written report in the council packet. CM distributed an executive summary and memo regarding revisions to the Park Master Plan. The council commented on curbside recycling and yard debris recycling. They would like to see more of both but realize that the franchise agreement is probably being met at this time. CM stated he would be meeting with the franchisee regarding these issues.
COUNCIL BUSINESS
School Board Meeting – CM Ealy, along with Cr. Cheshier, Cr. Arnold and
Mayor Austin, will attend the school board meeting on Wednesday to give a
15-minute presentation on city projects and issues that impact the school
district.
Estacada News Summer Visitor Guide – CM reviewed the information in the packet. Estacada News is asking for funding for a
24-page visitor’s guide for summer, 2004.
This would be a free publication that would highlight Estacada and the
events in and around Estacada. Cr.
Arnold moved to fund $1,050 for 10,000 copies for the visitor guide. Cr. Erickson seconded the motion. The motion passed unanimously.
Library Code of Conduct – Library Director McKinnon reviewed the proposed
code of conduct and the reasons for the code.
CA asked why #4 is not in the first section for immediate ejection. It was decided to include physical abuse and
sexual harassment of patrons or staff in section #1 resulting in immediate ejection
but leaving verbal and stalking in section #2.
Cr. moved to adopt the Estacada Public Library Code
of Conduct with the above changes. Cr.
Gavic seconded the motion. The motion
passed unanimously.
Dress Code
– CM reviewed the information in the handbook.
The council would like more detail than in our current handbook. Council would like CM to meet with staff and
come back with a revised dress and personal appearance section for the
handbook.
Ordinance Series of 2004, No. 2 – An Ordinance amending sections of the planning and zoning code.
CR Carey explained the ordinance and read Ordinance
Series of 2004, No. 2.
Cr. Arnold moved to dispense with the second reading
of the ordinance and read by title only.
Cr. Gavic seconded the motion.
The motion passed unanimously.
Cr. Cheshier moved to adopt Ordinance Series of
2004, No. 2 – An Ordinance amending sections of the planning and zoning
code. Cr. Erickson seconded the
motion. The motion passed unanimously.
Mayor Austin added the following issues to the
agenda for discussion with consensus of the council.
Percent for Art – Cr. Erickson reviewed the discussion at the last Estacada Area Arts
Commission meeting regarding some draft proposed language to add to the
ordinance proposed by Mayor Austin.
They liked the first paragraph but did not encourage the addition of any
other language. Mayor Austin asked CA
Cole to research how the use of funds from a district can be used or influenced
by city codes. Cr. Atkinson asked if
the council supports pursuing this issue before asking staff to proceed with
more research. Six councilors support
to have staff proceed with more research.
The council would like more information on the grants that are lined up
to cover this cost on the new library, how the one percent is applied to
districts, how the art is budgeted into a project and are there other
communities our size that have adopted this ordinance. The council would like to see the
information at the next meeting and not the ordinance.
Tourism Workgroup – Mayor Austin would like to see this workgroup begin. He would be willing to staff the meeting but
would like to see one set up within the next few weeks. CM stated that the next available time would
be late April or early May.

COMMENTS
Jennifer Joyce-Solomon, 850 NE Hill Way – Ms. Joyce-Solomon is an artist that has lived in Estacada for many years and seen many changes. She is a member of Artback and has participated in the creation of the murals in Estacada. She urged the city to step up and be leaders and vote yes on the one percent for art ordinance.
Joseph Cotter, 31819 SE Wildcat Mtn. Drive – Mr. Cotter is a local artist and echoes Ms.
Joyce-Solomon’s statements.
Gary Warkentin, 32795 Coupland Road – Mr. Warkentin is a strong supporter of the arts
and supports the one percent for arts ordinance. He feels the ordinance should not be connected to the library
project.
Jane Reid, Estacada Arts Commission – Ms. Reid asked the council to clarify what they
want the commission to do at this time.
Mayor Austin asked if there were other ordinances that apply to all
public buildings, not just city owned and if there are other cities the size of
Estacada that are currently doing this.
Cr. Arnold would like to know if donated art would qualify for the one
percent and will there be grants to cover additional costs for arts for smaller
projects such as a new skate park. CM
stated that this could all be researched by staff.
Jack Townes, 26395 S. Morgan Road – Mr. Townes commented how public art would be
selected and budgeted for. He stated
you could make the art functional such as an entrance to the park, a bench or
signage for the park.
The council would like to have final say on any art
and at this time the policy may not provide for this. CM will review the policy and be sure that the council has final
say and the art selection committee makes a recommendation for the council.
COUNCIL REPORTS &
COMMENTS
Cr. Gavic asked everyone to be progressive and to
keep things moving in the positive in Estacada.
Cr. Arnold stated the skate park group is moving
ahead but the Parks and Recreation Commission would like to look at other sites
such as at the school. The feedback Cr.
Arnold is getting is that people want the Wade Creek Park to contain a skate
park along with other structures. Cr.
Arnold commends Barbara Mattson for fundraising to help improve the downtown
area by buying paint to touch up the buildings along Broadway.
Cr. Cheshier really likes the idea of a bike
registration program through the Clackamas County Sheriff’s office.
Cr. Atkinson informed the council that the comp plan
group would meet next Monday night at 6:00 pm to review the planning zones in
the UGB.
Mayor Austin was in Newport where he saw many
murals. He also provided information to
the council on wilderness areas and proposals to preserve these areas.
EXECUTIVE SESSION – ORS
196.660(2)(h) – Litigation
Mayor Austin announced that the council would adjourn into executive session under ORS 192.660(2)(h) which allows the Council to meet in executive session to consult with counsel concerning the legal rights and duties of a public body with regard to current litigation or litigation likely to be filed. He asked everyone to leave the room except those representing the media. He advised the media representatives that they couldn’t report the contents of the executive session.
All the council and staff listed above were present
and Chris Randall, Public Works Director.
The council returned to regular session.
Cr. Arnold moved to stipulate with Mr. Misley’s attorney for the $500 settlement to the city. Cr. Atkinson seconded the motion. The motion passed unanimously.
EXECUTIVE SESSION – ORS
196.660(2)(e) – Real Property Transactions
Mayor Austin announced that the council would adjourn into executive session under ORS 192.660(2)(e) which allows the Council to meet in executive session to conduct deliberations with persons designated by the governing body to negotiate real property transactions. He asked everyone to leave the room except those representing the media. He advised the media representatives that they couldn’t report the contents of the executive session.

EXECUTIVE SESSION – ORS
196.660(2)(b) – Personnel
Mayor Austin announced that the council would
adjourn into executive session under ORS 192.660(2)(b) which allows the Council
to meet in executive session to consider the dismissal or disciplining of, or
to hear complaints or charges brought against, a public officer, employee,
staff member or individual agent, unless such public officer, employee, staff
member or individual agent requests and open hearing. He asked everyone to leave the room except those representing the
media. He advised the media
representatives that they couldn’t report the contents of the executive
session.
