COMMISSION MINUTES
CITY HALL
THURSDAY, SEPTEMBER
26, 2002 - 7:00 PM
1. CALL TO ORDER
The meeting was called to order at
7:00 pm.
2. ROLL CALL
Present: Cm. McGregor, Cm. Crosby, Cm. Sager, Cm.
Holden, Cm. Cameron, CP McCallister, DCR Hovda.
Absent: Cm. Erickson and Cm. Pettitt.
3. APPROVAL OF THE
JULY 11, 2002 MINUTES
Cm. Holden moved
to approve the July 11, 2002 minutes.
Cm. McGregor seconded the motion.
Motion passed unanimously.
4. PUBLIC HEARING
Conditional Use #2002-07.
The applicant, Bernard Atkinson (Family Ford), is requesting a
conditional use according to Sections 16.36.030(E) of the Estacada Municipal Code,
to allow for an auto sales and display area. Property is described as 34E,
20BA, tax lots 100 & 200 - corner of Hwy 224 & Rivermill Road. The subject property is zoned M-1 (light
industrial). This application is
subject to section 16.36, 16.76 & 16.88 of the Estacada Municipal
Code.
Cm. Cameron
closed the Planning Commission meeting and opened the public hearing. He asked for abstentions or exparte contact
- there was none.
CP reviewed the
staff report, which recommends denial due to the lack of information submitted
that is needed to determine some of the standards.
Cm. Holden asked
if the library were to move out to this area who would be responsible for
dealing with the traffic.
CP stated that a
governmental use is an outright use so traffic would not be addressed. The same would go if any other outright
industrial use were to move to this area.
Cm. McGregor
asked what would trigger a traffic light being required.
CP stated that
it is the level of service that would trigger a traffic light requirement.
Cm. Crosby asked
who would do the recommended site plan review.
CP stated that typically City staff does it, but the Planning Commission
has the ability to require the site plan be reviewed and approved by the Planning
Commission.
Cm. Cameron read
a statement regarding evidence.
Cliff Atkinson,
408 NE Shafford, applicant, stated this is not a permanent building, just a
temporary building so they can move some of their vehicles and get into a more
visible location. They are not sure how
big the paved area will be at this time.
They will be putting a mobile modular on the property and will not be
connecting it to water or sewer, as it will not have any restroom facilities. They will connect to electricity and will
meet all requirements. He stated that
there would only be one or two staff on site at a time so they will not need
much off street parking. He also stated
that they will not be installing any additional signage, their access will be
from Veteran's Blvd, they will meet any ADA requirements and also will meet
ODOT's requirements regarding storm drainage.
He reminded the Commission that this is a re-application -they
previously had a conditional use permit, but they let it expire.
Cm. McGregor
stated that last time they reviewed this property the Commission determined the
sales area would be the same as the sales room, which would make the off street
parking requirement larger.
CP stated the
city code determines the off street parking requirement based upon the building
floor area, but the Planning Commission can require additional spaces if they
want.
Mr. Atkinson
stated they would put in several off street spaces for their customers.
The Commission
asked if the applicant has to connect to the water, sewer and storm drain
systems. CP stated they must connect to
the storm drain system, but they would only have to connect to the water and
sewer systems if it is required under the building code because it is a public
building.
Cm. McGregor
asked about site obscuring fencing for storage areas. CP stated that all that is beomg proposed is parking of cars for
sale.
Mr. Atkinson
stated they are only displaying cars on the property.
Cm. Cameron
reminded the Commission if they approve this tonight, they must be comfortable
with it being there for 10 years or longer.
If the applicant wants to build a permanent building they must reapply.
Cm. Cameron
closed the public hearing and reopened the Planning Commission meeting.
CP asked the
applicant how many buildings they are proposing to site on the property. Mr. Atkinson stated they are not sure if
they will need one or two, but would like approval for two just in case they
need that many.
Cm. Cameron
feels they need a restroom on site for customers.
Cm. McGregor
moved to approve Conditional Use #2002-7 with the conditions in the staff
report and to also require connection to city water and sewer if the building
code requires it, and to require the
site plan be reviewed and approved by the Planning Commission. Cm. Crosby seconded the motion. Roll Call Vote: Cm. McGregor - yes, Cm. Crosby - yes, Cm. Sager - yes, Cm. Holden
- no, Cm. Cameron - yes. Motion passed
